Pinabete Mine


Navajo Transitional Energy Company, permittee of the Pinabete Mine has submitted to OSMRE a permit renewal application to renew the Pinabete Mine SMCRA permit (Federal Permit for Indian Lands: NM-0042A). The Pinabete SMCRA Permit was issued on July 6, 2016 for a five-year permit term. This renewal application would allow for continued operations and reclamation activities to continue for a period from July 6, 2021 to July 6, 2026.

Under terms of SMCRA and its implementing regulations any valid surface coal mining permit shall carry with it the right of successive renewal. The Pinabete Mine Permit Renewal Application is submitted to continue operations pursuant to Federal Regulations (CFR Title 30, Subchapter E – Section 750 and Subchapter F Section 773 and 774.

Document Review

This application has been filed with OSMRE and will be acted upon pursuant to the permanent regulatory program for Indian Lands (30 CFR Part 750) approved by the Secretary of the Interior under Title V of the Surface Mining Control and Reclamation Act of 1977.


Any person with an interest that is or may be adversely affected may submit written comments, objections, or a request for an informal conference on the application, within 30 days of the fourth and last publication of this notice.
