Navajo Mine Phase I Bond Release Application

Navajo Transitional Energy Company (NTEC), Navajo Mine has filed an application with the Office of Surface Mining Reclamation and Enforcement (OSMRE) for Phase I bond liability release of portions of lands located within the Navajo Mine lease (permit No. NM-0003F, issued on September 25, 2009). NTEC is not seeking a release from bond liability associated with its current Surety Bond Number 09143016 held through Zurich American Insurance Company, but only to release the lands described below in the bond release application documents.

The Phase I bond release application consists of information contained in the currently approved permit application package (OSMRE Permit No. NM-0003F). The application outlines NTEC’s reclamation operations on Permanent Program lands. The total size of the area sought for release is 1,240 acres. Reclamation on these areas was completed between 1993 and 2014. Reclamation activities consisted of back filling and regrading to the approximate original contour or to the approved final surface. Other reclamation activities during this time include mitigation of unsuitable material and drainage control construction. Navajo Mine permit is under Navajo Tribal Coal Lease 14-20-603-2505 and pursuant to the Code of Federal Regulations (CFR), Title 30, Subchapter E, Part 750, 773, and 774.
