Area IV North

Update 12-29-2015: Pursuant to the National Environmental Policy Act (NEPA), the Office of Surface Mining Reclamation and Enforcement (OSMRE) has prepared a Revised Environmental Assessment (EA) and Finding of No New Significant Impact (FONNSI). The Revised EA amends an EA prepared by OSMRE in 2012. The 2012 EA was used to support OSMRE’s March 16, 2012, approval of the Area IV North permit revision application to add mining area to the Navajo Mine.

On April 6, 2015, the U.S. District Court for the District of Colorado vacated and remanded OSMRE’s 2012 EA and Finding of No Significant Impact (FONSI); and also vacated the agency’s March 16, 2012, permit revision approval. In making the April 6, 2015, decision, the Court concluded that OSMRE violated NEPA by failing to adequately consider the environmental impacts related to the combustion of coal to be mined as a result of its approval of the Area IV North permit revision application.

As required by the court decision, the Revised EA/FONNSI evaluates the potential impacts of the combustion of the coal mined in Area IV North, and as a result of this analysis, OSMRE may reapprove the permittee’s (Navajo Transitional Energy Company) proposed expansion into Area IV North of the Navajo Mine.
