King II Mine Mining Plan Modification Environmental Assessment

Welcome to the OSMRE King II Coal Mine mining plan modification Environmental Assessment (EA) webpage. The EA was prepared by OSMRE and the Bureau of Land Management (BLM) as co-leads. Here you will be able to view and download documents relating to this EA as they become available to the public. For more information about this project see About the Project. OSMRE and BLM are soliciting public comments on the EA and unsigned FONSI. Your comments will help to determine the issues and alternatives that will be evaluated in the environmental analysis. You are invited to direct these comments by mail to:

Comments should be received or postmarked no later than July 10, 2017 in order to be considered during the preparation of the EA. Comments received, including names and addresses of those who comment, will be considered part of the public record for this project and will be available for public inspection. King II Mine Permit Renewal and Significant Permit Revision Applications

GCC Energy, LLC, owner and operator of the King II coal mine located at 6473 County Road 120, Hesperus, CO, 81326, (970) 385-4528, has submitted a permit renewal application to renew the existing Federal Mining and Reclamation Permit CO-0106A with the U.S. Department of the Interior’s Office of Surface Mining Reclamation and Enforcement (OSMRE). The permit renewal application is submitted to continue underground mining pursuant to the Code of Federal Regulations (CFR Title 30, Subchapter E, 750 and Subpart F, 773 and 774). Additionally, GCC Energy has submitted a permit revision application to update several sections of the existing permit to include the shadow area related to a proposed modification expanding the existing Federal Coal Lease COC62920.

The Office of Surface Mining Reclamation and Enforcement (OSMRE) received GCC Energy LLC’s (GCC) March 20, 2017, application to revise King II Mine Permit: CO-0106A. The revision includes acreage from a proposed Modification to BLM lease COC-62920, and new and revised PAP sections which reflect regulatory formatting changes, as well as operational updates, since the original permit issuance on April 17, 2007, and revised on September 09, 2010.

OSMRE has determined the revision to be significant based on public interest in the proposed revision. Therefore, in accordance with §774.13(b)(2), guidelines establishing the scale or extent of revisions for which all the permit application information requirement and procedures including notice, public participation, and notice of decision requirements of §773.6 and §778.21, shall apply.

Written comments, objections or requests for informal conferences on the renewal or revision applications may be submitted within 30 days of the fourth and last publication of this notice, by any person with an interest that is or may be adversely affected.
